In a significant legal decision, U.S. District Judge Michael Barrett has found Total Quality Logistics (TQL), the second-largest freight brokerage in the United States, in violation of federal labor laws. The ruling, issued on September 26, comes after an 18-month-long legal battle and a 12-day bench trial that concluded in March 2022.
Judge Barrett’s ruling mandates that TQL must pay overtime wages to thousands of former employees who worked more than 40 hours a week. Additionally, TQL is required to provide compensation equal to the actual damages incurred. Notably, the ruling also holds Ken Oaks, the Chief Executive and co-founder of TQL, personally liable for the violations.
